T\u00fcrkiye yirmi bir ay\u0131 a\u015fk\u0131n s\u00fcredir OHAL ve OHAL KHK\u2019leri ile y\u00f6netiliyor.<\/p>\n<p>OHAL KHK\u2019leri ile yap\u0131lamayacak nitelikte i\u015flemler yap\u0131l\u0131yor, yap\u0131labiliyor; \u00e7\u00fcnk\u00fc Anayasa Mahkemesi (AYM) OHAL KHK\u2019lerini incelemeyece\u011fine h\u00fckmetti. Bu durumda bizlerin, \u2018AYM taraf\u0131ndan denetlenemeyen OHAL KHK\u2019leri ile kad\u0131n\u0131 erkek, erke\u011fi kad\u0131n yapmak m\u00fcmk\u00fcn m\u00fc?\u2019 sorusunu y\u00f6neltmemiz, \u00e7ok mu abs\u00fcrt olur?<\/p>\n<p>Me\u015fhur bir f\u0131krad\u0131r. \u0130stihbarat \u00f6rg\u00fctleri aras\u0131nda bir yar\u0131\u015fma yap\u0131lm\u0131\u015f. Yar\u0131\u015fmaya KGB, CIA, MOSSAD ve M\u0130T kat\u0131lm\u0131\u015f. Hedef ormandan tav\u015fan getirmekmi\u015f. S\u0131rayla t\u00fcm istihbarat \u00f6rg\u00fctleri ormandaki tek tav\u015fan\u0131 bulmak i\u00e7in g\u00f6nderilmi\u015f ve farkl\u0131 s\u00fcrelerle tav\u015fanla geri gelmi\u015fler. Son olarak s\u0131ra M\u0130T\u2019e gelmi\u015f. M\u0130T k\u0131sa bir s\u00fcre sonra bir fille geri d\u00f6nm\u00fc\u015f. Yar\u0131\u015fma organizat\u00f6rleri \u201cTav\u015fan getirecektiniz, fil de\u011fil\u201d deyince a\u011fz\u0131 burnu da\u011f\u0131lm\u0131\u015f fil at\u0131lm\u0131\u015f \u201cYemin ederim ben tav\u015fan\u0131m abi\u201d demi\u015f.<\/p>\n<p>21. ay\u0131n\u0131 dolduran ola\u011fan\u00fcst\u00fc hal d\u00f6neminde \u00e7\u0131kar\u0131lan OHAL Kanun H\u00fckm\u00fcnde Kararnamelerine (KHK) bak\u0131nca benzer bir d\u00fc\u015f\u00fcnceye kap\u0131lmadan edemiyor insan. File \u201cBen tav\u015fan\u0131m\u201d dedirtme \u00f6rne\u011finde oldu\u011fu gibi OHAL KHK\u2019si ile ilgisi olmayan metinlere zorla OHAL KHK\u2019si dememiz isteniyor. O OHAL KHK\u2019lerine \u0130ngiltere\u2019de Parlamentoya verilen yetkiler kadar geni\u015f yetkiler verilmek isteniyor. Ama nas\u0131l tav\u015fan fil olmazsa, OHAL KHK\u2019si olmayan bir metin de zorla OHAL KHK\u2019si olamaz. Ne var ki tav\u015fan getirilecek bir yar\u0131\u015fmada fil getirirseniz bunun yapt\u0131r\u0131m\u0131 bellidir, yar\u0131\u015fmay\u0131 kazanamazs\u0131n\u0131z. Peki OHAL KHK\u2019si olmayan bir metne OHAL KHK\u2019si muamelesi yapt\u0131\u011f\u0131n\u0131zda yapt\u0131r\u0131m\u0131 ne olmal\u0131d\u0131r? Bu yaz\u0131da, hukuk d\u00fczenimizin file tav\u015fan demeye izin verip vermedi\u011fini saptamaya \u00e7al\u0131\u015faca\u011f\u0131z.<\/p>\n<p>K\u0131sa bir s\u00fcre \u00f6nce yazd\u0131\u011f\u0131m\u0131z raporda, 20 Temmuz 2016 tarihinde ba\u015flayan (bundan sonra \u201c20 Temmuz Rejimi\u201d olarak adland\u0131raca\u011f\u0131z) OHAL rejiminin atipikli\u011fini bu d\u00f6nemde \u00e7\u0131kan belirli bir t\u00fcr KHK \u00fczerinden incelemi\u015ftik.<sup class=\"modern-footnotes-footnote \" data-mfn=\"1\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"&#8220;Atipik OHAL KHK&#8217;ler ve Daimi Hukuksuzluk Art\u0131k Yasalar\u0131 \u0130dare mi \u0130ptal Edecek&#8221; Ola\u011fan\u00fcst\u00fc Hal ve Uygulamalar\u0131 Bilgi Notu 1, \u0130nsan Haklar\u0131 Ortak Platformu, 8 Mart 2018\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000007d6d54d6000000003096fcfe_189-1\">1<\/a><\/sup><span id=\"mfn-content-000000007d6d54d6000000003096fcfe_189-1\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"1\">&#8220;Atipik OHAL KHK&#8217;ler ve Daimi Hukuksuzluk Art\u0131k Yasalar\u0131 \u0130dare mi \u0130ptal Edecek&#8221; Ola\u011fan\u00fcst\u00fc Hal ve Uygulamalar\u0131 Bilgi Notu 1, \u0130nsan Haklar\u0131 Ortak Platformu, 8 Mart 2018<\/span><\/p>\n<p>An\u0131lan yaz\u0131da 20 Temmuz rejimi KHK\u2019lerini iki gruba ay\u0131rarak ele alm\u0131\u015ft\u0131k. Hat\u0131rlatmak gerekirse;<\/p>\n<ol>\n<li>OHAL ile ilgisi olmayan ve ola\u011fan yasalarla d\u00fczenlenmesi gereken konular\u0131 d\u00fczenleyen ve dolay\u0131s\u0131yla yasama yetkisinin devri niteli\u011fini ta\u015f\u0131yan KHK\u2019ler.<\/li>\n<li>Genel, soyut ve ki\u015filik d\u0131\u015f\u0131 kurallar i\u00e7ermeyen, ki\u015fiselle\u015ftirilmi\u015f cezaland\u0131rma niteli\u011finde olan ve bu nedenle yarg\u0131 yetkisinin devri niteli\u011fini ta\u015f\u0131yan KHK\u2019ler.<\/li>\n<\/ol>\n<p>\u0130lk de\u011ferlendirmemiz yukar\u0131daki ayr\u0131mda g\u00f6sterilen ikinci tip KHK\u2019lere ili\u015fkindi.<\/p>\n<p>\u0130lk tip KHK\u2019ler ve daha genel olarak 20 Temmuz Rejimi KHK\u2019lerinin hukuki de\u011ferlendirmesini ise bir ba\u015fka \u00e7al\u0131\u015fmaya b\u0131rakm\u0131\u015ft\u0131k.<\/p>\n<p>\u0130kinci tip KHK\u2019lerden farkl\u0131 olarak ilk tip KHK\u2019ler \u2018genel, ki\u015filik d\u0131\u015f\u0131 ve soyut\u2019 kurallar koyduklar\u0131 i\u00e7in ilk bak\u0131\u015fta \u201ckanun h\u00fckm\u00fcnde\u201d olabilir KHK\u2019ler olarak kar\u015f\u0131m\u0131za \u00e7\u0131k\u0131yorlar. Ancak bu KHK\u2019ler a\u00e7\u0131s\u0131ndan da birbirine ba\u011fl\u0131 \u00fc\u00e7 soru ortaya \u00e7\u0131k\u0131yor:<\/p>\n<p><strong>Birincisi\u00a0<\/strong>bu KHK\u2019lerin ger\u00e7ekten OHAL KHK\u2019si olup olmad\u0131\u011f\u0131 sorusu.\u00a0<strong>\u0130kinci olarak\u00a0<\/strong>OHAL KHK\u2019sinin bir yasaya d\u00f6n\u00fc\u015f\u00fcp d\u00f6n\u00fc\u015femeyece\u011fi meselesi.\u00a0<strong>\u00dc\u00e7\u00fcnc\u00fcs\u00fc\u00a0<\/strong>ise bu hususun AYM taraf\u0131ndan denetlenip denetlenemeyece\u011fi konusu.<\/p>\n<p><strong>AYM\u2019nin 2016 karar\u0131 ve sonraki denetime etkisi<\/strong><\/p>\n<p>\u0130ncelemeye son sorudan ba\u015flamak gerekiyor. \u00c7\u00fcnk\u00fc bilindi\u011fi gibi AYM, 2016 y\u0131l\u0131nda OHAL KHK\u2019leri hakk\u0131nda verdi\u011fi kararla \u2018\u00f6nceki\u2019 i\u00e7tihad\u0131ndan d\u00f6nm\u00fc\u015f ve OHAL KHK\u2019lerinin anayasall\u0131k denetimine tabi olmad\u0131\u011f\u0131n\u0131 saptam\u0131\u015ft\u0131.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"E.2016\/166, K. 2016\/159, 12.10. 2016; E. 2016\/167, K.2016\/160, 12.10. 2016; E. 2016\/171 K.\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000007d6d54d6000000003096fcfe_189-2\">2<\/a><\/sup><span id=\"mfn-content-000000007d6d54d6000000003096fcfe_189-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">E.2016\/166, K. 2016\/159, 12.10. 2016; E. 2016\/167, K.2016\/160, 12.10. 2016; E. 2016\/171 K.<\/span> Bu denetlenemezlik halinin OHAL KHK\u2019lerinin \u2018yasala\u015fmas\u0131ndan sonra\u2019 da s\u00f6z konusu olup olmad\u0131\u011f\u0131 \u00f6nemlidir.<\/p>\n<p>\u015e\u00fcphesiz AYM, bu KHK\u2019ler yasala\u015ft\u0131ktan sonra, herhangi bir yasay\u0131 denetledi\u011fi gibi bu yasalar\u0131 esas bak\u0131m\u0131ndan Anayasaya ayk\u0131r\u0131 bulup iptal edebilir. Buradaki sorun, ya da bizim sorumuz bu de\u011fil.\u00a0<strong>Sorun, AYM\u2019nin yasala\u015fm\u0131\u015f OHAL KHK\u2019lerinin OHAL KHK\u2019si olup olmad\u0131\u011f\u0131n\u0131 denetleyip denetleyemeyece\u011fi.\u00a0<\/strong>\u00c7\u00fcnk\u00fc e\u011fer OHAL KHK\u2019si, OHAL KHK\u2019si oldu\u011fu s\u0131rada denetlenemiyorsa, bu denetimin yap\u0131labilece\u011fi tek a\u015fama kural\u0131n yasala\u015fmas\u0131 sonras\u0131 olabilir. Bu a\u015famada da bir KHK\u2019nin OHAL KHK\u2019si olup olmad\u0131\u011f\u0131 denetlenemiyorsa, esasen OHAL KHK\u2019lerinin hi\u00e7bir \u015fekilde denetlenemedi\u011fi sonucu ortaya \u00e7\u0131kacak, OHAL KHK\u2019lerinin tamamen denetlenemez bir d\u00fczenleme tipi oldu\u011fu sonucuna ula\u015f\u0131lacakt\u0131r. Bir ba\u015fka deyi\u015fle, OHAL KHK\u2019siyle, OHAL\u2019le ilgili olsun olmas\u0131n her konu d\u00fczenlenebilecek ve bu durum<u>\u00a0\u2018getirilen kural\u2019<\/u>\u00a0KHK iken OHAL KHK\u2019si olup olmad\u0131\u011f\u0131 denetlenemedi\u011fi gibi, yasa olduktan sonra da denetlenemeyecektir.<\/p>\n<p>Bir kez daha vurgulamak zorunlu g\u00f6r\u00fcn\u00fcyor: Burada s\u00f6z konusu edilen denetim, yasa haline gelmi\u015f bir kural\u0131n di\u011fer t\u00fcm yasalar gibi esas bak\u0131m\u0131ndan denetimi de\u011fildir. \u00d6rne\u011fin 7072 Say\u0131l\u0131 Yasa ile 680 Say\u0131l\u0131 KHK yasala\u015fm\u0131\u015ft\u0131r. Bu yasada OHAL\u2019le ili\u015fkilendirilemeyecek \u00e7ok say\u0131da h\u00fck\u00fcm vard\u0131r: \u00d6rne\u011fin Yasan\u0131n 6. maddesi uyar\u0131nca 2802 Say\u0131l\u0131 Hakimler ve Savc\u0131lar Kanununun 9\/A maddesinin birinci c\u00fcmlesinde yer alan \u201cen az yetmi\u015f puan almak kayd\u0131yla\u201d h\u00fckm\u00fc y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. AYM, t\u00fcm di\u011fer yasa h\u00fck\u00fcmlerinde oldu\u011fu gibi bu de\u011fi\u015fikli\u011fin esas bak\u0131m\u0131ndan Anayasaya ayk\u0131r\u0131 oldu\u011funa karar verebilir. Ancak burada sormak istedi\u011fimiz soru \u015fudur: Bu h\u00fck\u00fcm ve di\u011ferleri a\u00e7\u0131s\u0131ndan, AYM esasa bakmadan kural\u0131n OHAL\u2019le ilgisi olmad\u0131\u011f\u0131n\u0131 saptay\u0131p bu nedenle OHAL KHK\u2019si olmayan bir h\u00fckm\u00fcn sonras\u0131nda kanun haline de gelmeyece\u011fini saptayabilir mi? AYM\u2019nin daha \u00f6nceki i\u00e7tihattan d\u00f6nen 2016 kararlar\u0131 bu konuyu a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmam\u0131\u015ft\u0131r.<\/p>\n<p>AYM\u2019nin OHAL KHK\u2019lerini denetlememe konusundaki tutumu, bu sat\u0131rlar\u0131n yazarlar\u0131 da dahil olmak \u00fczere \u00e7ok say\u0131da kamu hukuk\u00e7usu taraf\u0131ndan ele\u015ftirilmi\u015ftir. Ele\u015ftirileri tekrar etmeyi anlaml\u0131 bulmuyoruz. Bununla birlikte AYM bu karar\u0131nda bir yandan kendi i\u00e7tihad\u0131ndan saparken, di\u011fer yandan \u2018denetlenemezlik\u2019 alan\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131 da \u00e7izmi\u015ftir. \u015e\u00f6yle ki:<\/p>\n<p>\u201c\u0130darenin her t\u00fcrl\u00fc eylem ve i\u015flemlerine kar\u015f\u0131 yarg\u0131 yolunun a\u00e7\u0131k olmas\u0131, hukuk devleti ilkesinin gere\u011fidir. Kanun h\u00fckm\u00fcndeki d\u00fczenlemeler, yarg\u0131 denetimine konu yap\u0131labildikleri \u00f6l\u00e7\u00fcde temel hak ve \u00f6zg\u00fcrl\u00fckler etkili \u015fekilde korunmu\u015f ve g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f olur. [\u2026] Ancak bu durum, yarg\u0131sal denetime istisna getiren anayasal h\u00fck\u00fcmlerin varl\u0131\u011f\u0131n\u0131 ve uygulanmas\u0131n\u0131 etkilemez. Anayasa\u2019da, 90. maddenin be\u015finci f\u0131kras\u0131, 125. maddenin ikinci f\u0131kras\u0131, 159. maddenin onuncu f\u0131kras\u0131 gibi yarg\u0131 denetimini k\u0131s\u0131tlayan kimi istisnai maddelere yer verilmi\u015ftir.\u201d<sup class=\"modern-footnotes-footnote \" data-mfn=\"3\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"E.2016\/166, K. 2016\/159, 12.10. 2016, para. 12.\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000007d6d54d6000000003096fcfe_189-3\">3<\/a><\/sup><span id=\"mfn-content-000000007d6d54d6000000003096fcfe_189-3\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"3\">E.2016\/166, K. 2016\/159, 12.10. 2016, para. 12.<\/span><\/p>\n<p>Bu durumda \u2018kural\u2019 yarg\u0131sal denetimin yap\u0131lmas\u0131; \u2018istisna\u2019 ise buna Anayasa\u2019da a\u00e7\u0131k istisnalar getirilmesidir. AYM\u2019ye g\u00f6re 148. madde bu istisnalardan biridir. Ancak bu durum kabul edilse bile bu temel hak ve \u00f6zg\u00fcrl\u00fckleri k\u0131s\u0131tlayan istisnalar\u0131n dar yorumlanmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. OHAL KHK\u2019lerinin Anayasaya uygunluk denetimi yap\u0131lamamaktad\u0131r \u00e7\u00fcnk\u00fc, \u201cAnayasa\u2019n\u0131n 148. maddesinin lafz\u0131, Anayasa koyucunun amac\u0131 ve ilgili yasama belgeleri g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda, ola\u011fan\u00fcst\u00fc d\u00f6nem KHK\u2019lar\u0131n\u0131n herhangi bir ad alt\u0131nda yarg\u0131sal denetime tabi tutulamayaca\u011f\u0131 a\u00e7\u0131kt\u0131r.\u201d<sup class=\"modern-footnotes-footnote \" data-mfn=\"4\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"Ayn\u0131 karar, para. 23. 2016\/164, 2.11.2016; E. 2016\/172 K. 2016\/165, 2.11. 2016.\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000007d6d54d6000000003096fcfe_189-4\">4<\/a><\/sup><span id=\"mfn-content-000000007d6d54d6000000003096fcfe_189-4\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"4\">Ayn\u0131 karar, para. 23. 2016\/164, 2.11.2016; E. 2016\/172 K. 2016\/165, 2.11. 2016.<\/span><\/p>\n<p>\u0130stisnalar\u0131n dar yorumlanmas\u0131 gere\u011fi Anayasa\u2019n\u0131n sistematik bir \u015fekilde yorumlanmas\u0131n\u0131 da gerektirir.\u00a0<strong>OHAL KHK\u2019lerinin yarg\u0131sal denetime kapal\u0131 olmas\u0131n\u0131n nedeni, Anayasa\u2019n\u0131n b\u00fct\u00fcn\u00fcnden anla\u015f\u0131labilir.\u00a0<\/strong>OHAL d\u00f6neminde normal zamanlarda al\u0131nacak \u00f6nlemlerin \u00f6tesine ge\u00e7mek ve ola\u011fan zamanlarda ge\u00e7erli olamayacak \u00f6nlemleri s\u00fcratle almak gerekebilecektir. Bu \u00f6nlemlerin de yarg\u0131sal denetim tehdidi ile geciktirilmesi bu d\u00f6nem i\u00e7in uygun g\u00f6r\u00fclmemi\u015ftir.\u00a0<strong>Ancak yine Anayasa, OHAL KHK\u2019lerinin TBMM onay\u0131na sunulmas\u0131n\u0131 zorunlu k\u0131larak bu durumun ilelebet s\u00fcrmesine m\u00fcsaade\u00a0 de\u00a0 etmemi\u015ftir.\u00a0\u00a0<\/strong>O\u00a0 halde\u00a0 OHAL KHK\u2019lerinin yarg\u0131sal denetim d\u0131\u015f\u0131nda kalaca\u011f\u0131 d\u00f6nemin ge\u00e7ici olmas\u0131 ve sadece OHAL KHK\u2019si olduklar\u0131 d\u00f6nem i\u00e7in ge\u00e7erli oldu\u011funu kabul etmek gerekir.<sup class=\"modern-footnotes-footnote \" data-mfn=\"5\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"&#8220;Ola\u011fan\u00fcst\u00fc h\u00e2l KHK&#8217;leri T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinin onay\u0131ndan sonra kanuna d\u00f6n\u00fc\u015fece\u011finden bu kanunlar\u0131n Anayasaya uygunlu\u011funun Anayasa Mahkemesi taraf\u0131ndan denetlenebilece\u011fi do\u011fald\u0131r. Di\u011fer bir deyimle Anayasa, denetim yasa\u011f\u0131n\u0131 ancak onaydan \u00f6nceki safha i\u00e7in koymu\u015ftur&#8221;. Ergun \u00d6zbudun, T\u00fcrk Anayasa Hukuku, s. 216.<\/span><\/p>\n<p>A\u015fa\u011f\u0131da a\u00e7\u0131klanaca\u011f\u0131 gibi biz,\u00a0<strong>OHAL KHK\u2019lerinin yasa olarak kabul edilmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131\u00a0<\/strong>d\u00fc\u015f\u00fcn\u00fcyoruz. Ancak aksinin kabul\u00fc halinde bile, yasa olarak mecliste onaylanan metnin OHAL KHK\u2019si olmad\u0131\u011f\u0131n\u0131n tespiti halinde, i\u00e7eri\u011fine bak\u0131lmaks\u0131z\u0131n iptalinin gerekti\u011fi, AYM\u2019nin k\u0131s\u0131tlay\u0131c\u0131 yorumu \u00e7er\u00e7evesinde dahi m\u00fcmk\u00fcn g\u00f6r\u00fcnmektedir.<\/p>\n<p>Bir ba\u015fka deyi\u015fle, OHAL KHK\u2019sinin OHAL KHK\u2019si olup olmad\u0131\u011f\u0131na ili\u015fkin yarg\u0131sal denetimi iki ayr\u0131 zaman diliminde incelemek gerekir. Birincisi, OHAL KHK\u2019si Meclis\u2019te onaylanmadan \u00f6nceki; ikincisi, OHAL KHK\u2019sinin Meclis\u2019te onaylanmas\u0131ndan sonraki d\u00f6nemler. AYM\u2019ye g\u00f6re Anayasa\u2019n\u0131n 148. maddesi nedeniyle\u00a0<strong>ge\u00e7ici ve k\u0131sa olmas\u0131 gereken ilk d\u00f6nemde\u00a0<\/strong>yarg\u0131sal denetim yap\u0131lamayacakt\u0131r. Ancak OHAL KHK\u2019si Meclis\u2019te onayland\u0131ktan sonra, s\u00f6z konusu d\u00fczenleme OHAL KHK\u2019si niteli\u011fini kaybetti\u011fi i\u00e7in, 148. maddede \u00f6ng\u00f6r\u00fclen yarg\u0131 k\u0131s\u0131tlamas\u0131 da kalkm\u0131\u015f olacakt\u0131r.<sup class=\"modern-footnotes-footnote \" data-mfn=\"6\" data-mfn-post-scope=\"000000007d6d54d6000000003096fcfe_189\"><a href=\"javascript:void(0)\"  title=\"Ayn\u0131 y\u00f6nde bkz. Art\u0131k, bu d\u00fczenlemelerin \u2018her bir maddesinin Anayasa\u2019ya uygunlu\u011funun denetlenebilir olu\u015funun yan\u0131nda, ilk d\u00fczenlendi\u011fi anda OHAL KHK\u2019si niteli\u011fi ta\u015f\u0131y\u0131p ta\u015f\u0131mad\u0131\u011f\u0131n\u0131n tespiti yoluyla iptali de m\u00fcmk\u00fcn olacakt\u0131r.\u00a0<strong>Bu\u00a0yakla\u015f\u0131m kabul edilirse, yukar\u0131daki \u00f6rne\u011fi esas al\u0131rsak,\u00a0 hakimlik s\u0131nav\u0131ndaki baraj\u0131 kald\u0131ran h\u00fckm\u00fcn esas denetimine girmeksizin, salt OHAL\u2019le ilgisi bulunmad\u0131\u011f\u0131 i\u00e7in iptali gerekecektir.<\/strong><\/p>\n<p>Anayasa ve \u0130\u00e7t\u00fcz\u00fc\u011fe g\u00f6re yasalar\u0131n nas\u0131l yap\u0131laca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bir yasan\u0131n usul\u00fcne uygun olarak yasala\u015fmas\u0131 i\u00e7in \u00f6ncelikle bu s\u00fcreci ba\u015flatacak hukuki bir i\u015flem olmas\u0131 ve bu i\u015flemin de usul\u00fcne uygun bir \u015fekilde ger\u00e7ekle\u015ftirilmesi gerekir. Daha da somutla\u015ft\u0131rmak gerekirse; nas\u0131l yasa teklifi yapmaya yetkisi olmayan bir ki\u015finin teklifi, ilgili komisyonlardan ge\u00e7mez ve do\u011fal olarak Genel Kurul\u2019da oylan\u0131p yasa haline gelemezse; OHAL KHK\u2019si olmayan bir metin de Genel Kurul\u2019da bu s\u0131fatla onaylan\u0131p yasala\u015famaz. B\u00f6yle bir yasan\u0131n i\u00e7eri\u011fi ne olursa olsun iptali gerekir. Bunu yapabilecek tek yer de, yasa haline geldikten sonra o metinleri<\/p>\n<p>inceleme yetkisi olan AYM\u2019dir.<\/p>\n<p><strong>Bir OHAL KHK\u2019si yasa haline gelebilir mi?<\/strong><\/p>\n<p>AYM\u2019nin yarg\u0131sal denetimine ili\u015fkin k\u0131s\u0131tlaman\u0131n OHAL KHK\u2019sinin TBMM taraf\u0131ndan onaylanmas\u0131yla kalkt\u0131\u011f\u0131n\u0131 saptad\u0131\u011f\u0131m\u0131za g\u00f6re yukar\u0131da sordu\u011fumuz ilk soruya geri d\u00f6nebiliriz.\u00a0<strong>Bir OHAL KHK\u2019si yasa haline gelebilir mi?<\/strong><\/p>\n<p>\u0130lk raporumuzda, bir metnin \u2018yasa\u2019 ad\u0131n\u0131 alabilmesi i\u00e7in ta\u015f\u0131mas\u0131 gereken nitelikler anlat\u0131lm\u0131\u015ft\u0131. Buna g\u00f6re bir yasan\u0131n maddi anlamda yasa olmas\u0131 i\u00e7in ki\u015fiye \u00f6zel olmamas\u0131, genel ve soyut olmas\u0131 gerekir. OHAL KHK\u2019leri, do\u011fal olarak hem yasalardan hem de ola\u011fan d\u00f6nem KHK\u2019lerinden farkl\u0131 \u00f6zellikler ta\u015f\u0131yan metinlerdir. Asl\u0131nda, ad\u0131 d\u0131\u015f\u0131nda ola\u011fan d\u00f6nem KHK\u2019si ile bir benzerli\u011fi olmayan, t\u00fcm\u00fcyle farkl\u0131 bir d\u00fczenleme tipi oldu\u011funu s\u00f6ylemek yanl\u0131\u015f olmaz. Nedir bu farklar? \u00c7ok k\u0131saca \u015fu \u015fekilde \u00f6zetleyebiliriz: Her ne kadar her ikisi de bakanlar kurulunun bir i\u015flemi gibi g\u00f6r\u00fcnse de, OHAL KHK\u2019si ve ola\u011fan KHK\u2019ler, iki ayr\u0131 organ taraf\u0131ndan \u00e7\u0131kar\u0131l\u0131r. OHAL KHK\u2019si, di\u011ferinden farkl\u0131 olarak ancak \u2018Cumhurba\u015fkan\u0131 ba\u015fkanl\u0131\u011f\u0131nda toplanan bakanlar kurulu\u2019 taraf\u0131ndan \u00e7\u0131kar\u0131labilir. Yine, OHAL KHK\u2019si i\u00e7in yetki kanununa gerek yoktur. OHAL KHK\u2019si, OHAL ilan edilen yer dahilinde, OHAL i\u00e7in gerekli konularda ve OHAL s\u00fcresinde ge\u00e7erlidir. Dolay\u0131s\u0131yla OHAL KHK\u2019si konu a\u00e7\u0131s\u0131ndan s\u0131n\u0131rl\u0131 ve s\u00fcre a\u00e7\u0131s\u0131ndan ge\u00e7icidir. \u00d6te yandan, OHAL KHK\u2019si ola\u011fan KHK\u2019nin yapamad\u0131\u011f\u0131 bir \u015feyi yapabilir. Anayasa\u2019n\u0131n 91. maddesine g\u00f6re \u201cs\u0131k\u0131y\u00f6netim ve ola\u011fan\u00fcst\u00fc haller sakl\u0131 kalmak \u00fczere, Anayasan\u0131n ikinci k\u0131sm\u0131n\u0131n birinci ve ikinci b\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleri ile d\u00f6rd\u00fcnc\u00fc b\u00f6l\u00fcm\u00fcnde yer alan siyas\u00ee haklar ve \u00f6devler kanun h\u00fckm\u00fcnde kararnamelerle d\u00fczenlenemez\u201d. Bu fark\u0131n nedeni de kolayca anla\u015f\u0131labilir, temel haklar\u0131 kal\u0131c\u0131 olarak etkileyecek i\u015flemlerin bir idari i\u015flemle yap\u0131lmas\u0131 uygun g\u00f6r\u00fclmemi\u015ftir. Ge\u00e7ici ve acil nitelikte olan durumlarda ise bu kurala istisna getirilmi\u015ftir. OHAL KHK\u2019sinin amac\u0131, ola\u011fan d\u00f6nem ko\u015fullar\u0131na bir an \u00f6nce d\u00f6n\u00fclmesi i\u00e7in gerekenlerin yap\u0131lmas\u0131d\u0131r. Yukar\u0131da alt\u0131n\u0131 \u00e7izdi\u011fimiz gibi, iki KHK\u2019nin yaln\u0131zca ad\u0131 ortakt\u0131r.<\/p>\n<p>Bu durumda, ola\u011fan KHK\u2019lerin tek s\u0131n\u0131r\u0131 91. maddede g\u00f6sterilen konularda \u00e7\u0131kar\u0131lma yasa\u011f\u0131yken, OHAL KHK\u2019lere istisnai bir d\u00fczenleme alan\u0131nda s\u0131n\u0131rl\u0131 bir s\u00fcrede ge\u00e7erli olmak \u00fczere izin verilmi\u015ftir.<\/p>\n<p>Burada, \u2018sorunun\u2019 daha iyi anla\u015f\u0131lmas\u0131 i\u00e7in belki bir iki c\u00fcmleye daha gereksinim var:\u00a0<strong>E\u011fer OHAL KHK\u2019si, g\u00fcn\u00fcm\u00fcz T\u00fcrkiye\u2019sinde oldu\u011fu gibi, bir OHAL KHK\u2019sinin ta\u015f\u0131mas\u0131 gereken niteliklere sahip de\u011filse, yasa haline gelebilir mi? Genel, soyut, ki\u015filik d\u0131\u015f\u0131 olan ve fakat kal\u0131c\u0131 olmayan d\u00fczenleme getiren KHK\u2019ler? (<strong>a<\/strong>) tipinden farkl\u0131 olarak bunlar ola\u011fan\u00fcst\u00fc hale ili\u015fkindir ve o nedenle OHAL KHK\u2019sidir. Ancak bunlar\u0131n da yasala\u015fmas\u0131 s\u00f6z konusu olamaz, \u00e7\u00fcnk\u00fc yasala\u015ft\u0131klar\u0131 anda ge\u00e7ici ve ola\u011fan\u00fcst\u00fc hale ili\u015fkin olmaktan \u00e7\u0131k\u0131p (<strong>a<\/strong>) tipine d\u00f6n\u00fc\u015f\u00fcp kal\u0131c\u0131 olurlar.<\/p>\n<p>OHAL KHK\u2019leri, yasalardan t\u00fcm\u00fcyle farkl\u0131 niteliklere sahip oldu\u011fu i\u00e7in, yasalarda bir de\u011fi\u015fiklik yapamayaca\u011f\u0131 gibi, kendisi de bir yasa olamaz. Asl\u0131nda bu durumu bir c\u00fcmleyle \u015fu \u015fekilde \u00f6zetlemek m\u00fcmk\u00fcnd\u00fcr:<u>\u00a0<\/u><strong><u>Bir metin OHAL KHK\u2019si ise yasa, yasa ise OHAL KHK\u2019si de\u011fildir.\u00a0<\/u><\/strong>Bu durumda ne (<strong>a<\/strong>) tipi ne de (<strong>b<\/strong>) tipi KHK\u2019lerin yasala\u015fmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Bu a\u00e7\u0131klamalar\u0131m\u0131z sonras\u0131nda \u015fu soru sorulabilir. Madem yasalar\u0131 de\u011fi\u015ftiremiyor o halde OHAL KHK\u2019lerinin ad\u0131 neden KHK\u2019dir?<\/p>\n<p>Bu sorunun cevab\u0131n\u0131 Anayasa\u2019n\u0131n sistematik yorumunda bulmak m\u00fcmk\u00fcnd\u00fcr. Anayasa bir yandan genel esaslar\u0131 aras\u0131nda egemenli\u011fin yetkili organlar eliyle kullan\u0131laca\u011f\u0131n\u0131 s\u00f6yleyip (md. 6), yasama yetkisinin devredilemez oldu\u011funu belirtip (md. 7), bir yandan da her konunun s\u0131n\u0131rs\u0131z bir \u015fekilde OHAL KHK\u2019leri ile d\u00fczenlenmi\u015f olmas\u0131n\u0131 imkan veriyor olamaz. Sistematik yorum, bir hukuk metni i\u00e7indeki farkl\u0131 kurallar\u0131n b\u00fct\u00fcn halinde birbiriyle tutarl\u0131 bir \u015fekilde okunmas\u0131n\u0131 gerektirir. Bu tutarl\u0131l\u0131k, OHAL KHK\u2019lerinin ad\u0131n\u0131n KHK olmas\u0131n\u0131n, onlar\u0131n yasay\u0131 de\u011fi\u015ftirebilme g\u00fcc\u00fcnden de\u011fil yasaya etki g\u00fcc\u00fcnden gelmesi halinde m\u00fcmk\u00fcnd\u00fcr. OHAL KHK\u2019leri yasalar\u0131 de\u011fi\u015ftiremez ama ask\u0131ya alabilirler, ki isimleri de buradan gelmektedir. OHAL KHK\u2019leri, yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z nedenlerle, ola\u011fan d\u00f6nem KHK\u2019lerinden farkl\u0131 olarak yasalar\u0131 kal\u0131c\u0131 olarak de\u011fi\u015ftiremezler ama acil ihtiya\u00e7 nedeniyle yasama organ\u0131n\u0131n yetki yasas\u0131 olmaks\u0131z\u0131n ge\u00e7ici olarak yasalar\u0131 ask\u0131ya al\u0131rlar. Temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin d\u00fczenlemelerin bile bu kurallarla yap\u0131labilmesinin nedeni de budur. S\u0131n\u0131rl\u0131 bir s\u00fcre, yer ve konuya ili\u015fkin olan d\u00fczenleme yasama yetkisinin devri anlam\u0131na gelmeyece\u011fi i\u00e7in genel esaslarda belirtilen ilkeler de \u00e7i\u011fnenmi\u015f olmaz. E\u011fer ge\u00e7ici d\u00fczenleme yeterli de\u011filse yasama yetkisini kullanan TBMM normal usuller \u00e7er\u00e7evesinde yasa \u00e7\u0131kartabilir.<\/p>\n<p>Anayasa\u2019n\u0131n 121. maddesindeki \u201c119&#8217;uncu madde uyar\u0131nca il\u00e2n edilen ola\u011fan\u00fcst\u00fc hallerde vatanda\u015flar i\u00e7in getirilecek para, mal ve \u00e7al\u0131\u015fma y\u00fck\u00fcml\u00fcl\u00fckleri ile ola\u011fan\u00fcst\u00fc hallerin her t\u00fcr\u00fc i\u00e7in ayr\u0131 ayr\u0131 ge\u00e7erli olmak \u00fczere, Anayasan\u0131n 15&#8217;inci maddesindeki ilkeler do\u011frultusunda temel hak ve h\u00fcrriyetlerin nas\u0131l s\u0131n\u0131rlanaca\u011f\u0131 veya nas\u0131l durdurulaca\u011f\u0131, halin gerektirdi\u011fi tedbirlerin nas\u0131l ve ne suretle al\u0131naca\u011f\u0131, kamu hizmeti g\u00f6revlilerine ne gibi yetkiler verilece\u011fi, g\u00f6revlilerin durumlar\u0131nda ne gibi de\u011fi\u015fiklikler yap\u0131laca\u011f\u0131 ve ola\u011fan\u00fcst\u00fc y\u00f6netim usulleri, Ola\u011fan\u00fcst\u00fc Hal Kanununda d\u00fczenlenir\u201d h\u00fckm\u00fc de ancak bu \u015fekilde bir anlam kazanmaktad\u0131r. E\u011fer her yasa OHAL KHK\u2019leri ile d\u00fczenlenebilecek ve de\u011fi\u015ftirilebilecek olsayd\u0131, bu h\u00fckm\u00fcn hi\u00e7bir anlam\u0131 kalmazd\u0131. Oysa OHAL KHK\u2019leri sadece acil durumlara y\u00f6nelik ge\u00e7ici bir etki g\u00f6sterdi\u011fi i\u00e7in kal\u0131c\u0131 de\u011fi\u015fikliklerin Ola\u011fan\u00fcst\u00fc Hal Kanunu ve di\u011fer yasalarda ola\u011fan yollar izlenerek yap\u0131lmas\u0131 gerekmektedir.<\/p>\n<p>OHAL KHK\u2019lerinin TBMM taraf\u0131ndan \u2018onaylanmas\u0131\u2019 s\u00fcreci de bu yorumla tamamen uyumludur.<\/p>\n<p>Anayasa\u2019da, konuyu \u0130\u00e7t\u00fcz\u00fck\u2019e b\u0131rakan (md.121-122) d\u00fczenlemeye kar\u015f\u0131n, \u0130\u00e7t\u00fcz\u00fck\u2019te OHAL KHK\u2019lerinin onay\u0131na dair s\u00fcre ve usul konusu 1996 y\u0131l\u0131ndaki TBMM karar\u0131na kadar yer almam\u0131\u015ft\u0131r. 1996\u2019da ger\u00e7ekle\u015ftirilen kapsaml\u0131 \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fiyle, s\u00f6z konusu kararnameler i\u00e7in \u2018\u00f6zel\u2019 y\u00f6ntem ve s\u00fcre belirlenmi\u015ftir (md.128). D\u00fczenlemeye g\u00f6re OHAL KHK\u2019leri komisyonlarda (di\u011fer KHK, yasa tasar\u0131 ve tekliflerinden \u00f6nce) ve Genel Kurul\u2019da en ge\u00e7 30 g\u00fcn i\u00e7inde g\u00f6r\u00fc\u015f\u00fcl\u00fcr ve karar ba\u011flan\u0131r. Bir OHAL KHK\u2019sinin 30 g\u00fcn i\u00e7inde g\u00f6r\u00fc\u015f\u00fcl\u00fcp karara ba\u011flanmad\u0131\u011f\u0131 durumda reddedilip reddedilmemi\u015f say\u0131laca\u011f\u0131 ise, doktrinde tart\u0131\u015fmal\u0131d\u0131r. Onay verebilir, onaylamayabilir, ancak de\u011fi\u015ftiremez. <strong>Dolay\u0131s\u0131yla \u0130\u00e7t\u00fcz\u00fck\u2019te OHAL KHK\u2019leri i\u00e7in \u00f6ng\u00f6r\u00fclen \u2018onay\u2019 y\u00f6ntemi Anayasa\u2019ya ayk\u0131r\u0131d\u0131r.<\/strong><\/p>\n<p>Demek ki, OHAL KHK\u2019leriyle, ola\u011fan d\u00f6nem KHK\u2019lerinden farkl\u0131 olarak yasalar de\u011fi\u015ftirilemez. Bir OHAL KHK\u2019si, yasaya d\u00f6n\u00fc\u015ft\u00fcr\u00fclemez.<\/p>\n<p>Sorunu kavramak i\u00e7in tersten gidelim. Birinci yaz\u0131da inceledi\u011fimiz ihra\u00e7 kararnamelerinin neden yasa haline getirilemeyece\u011fini a\u00e7\u0131klarken OHAL konusu ve s\u00fcresi ile s\u0131n\u0131rl\u0131 \u201ctedbir\u201d kavram\u0131na ba\u015fvurmu\u015f, bunun s\u00fcrekli hale getirilemeyece\u011fini belirtmi\u015ftik. Bu tedbirlere ili\u015fkin genel ve soyut ilkeler Anayasa ve Ola\u011fan\u00fcst\u00fc Hal Kanunu\u2019nda \u00e7izilmi\u015ftir. \u0130hra\u00e7 kararnamelerine benzer bir konu olan 1402 say\u0131l\u0131 S\u0131k\u0131y\u00f6netim Kanunu\u2019na dayanarak bir daha geri d\u00f6nmemek \u00fczere i\u015flerinden \u00e7\u0131kar\u0131lanlar sorunu, tedbir ile yasa aras\u0131ndaki fark\u0131 ortaya koymak i\u00e7in \u00e7ok iyi bir \u00f6rnek sunar.<\/p>\n<p>1402 Say\u0131l\u0131 S\u0131k\u0131y\u00f6netim Kanunu\u2019na 2301 ve 2766 say\u0131l\u0131 Kanunlar ile s\u0131k\u0131y\u00f6netim komutan\u0131na sak\u0131ncal\u0131 buldu\u011fu ki\u015filerin g\u00f6revlerine son verme yetkisi verme yetkisi eklenmi\u015f ve g\u00f6revine bu \u015fekilde son verilenlerin bir daha kamu hizmetinde \u00e7al\u0131\u015ft\u0131r\u0131lamayacaklar\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Bu genel ve soyut kural nedeniyle binlerce ki\u015fi bir daha kamu hizmetine d\u00f6nmemek \u00fczere g\u00f6revinden uzakla\u015ft\u0131r\u0131lm\u0131\u015f ya da s\u00fcrg\u00fcn edilmi\u015ftir. Mahkeme yolu ise kapat\u0131lm\u0131\u015ft\u0131r. Dan\u0131\u015ftay\u2019\u0131n 1989 tarihli i\u00e7tihad\u0131 birle\u015ftirme karar\u0131na sebep olan olaylar\u0131n seyri izlendi\u011finde, yasa ve idari i\u015flem aras\u0131nda ayr\u0131m yapmak hem \u015fekil hem de esas bak\u0131m\u0131ndan m\u00fcmk\u00fcnd\u00fcr. Yasa, yasa yapma prosed\u00fcrlerine uyularak yap\u0131lm\u0131\u015f 1402 Say\u0131l\u0131 S\u0131k\u0131y\u00f6netim Yasas\u0131\u2019d\u0131r. \u0130dari i\u015flemler ise s\u0131k\u0131y\u00f6netim komutan\u0131n\u0131n kararlar\u0131d\u0131r. Dan\u0131\u015ftay\u2019\u0131n karar\u0131n\u0131n \u00f6z\u00fc ise s\u0131k\u0131y\u00f6netim yasas\u0131n\u0131n yaln\u0131zca s\u0131k\u0131y\u00f6netim d\u00f6nemi ile s\u0131n\u0131rl\u0131 bir yetki verdi\u011fidir.<\/p>\n<p>Dolay\u0131s\u0131yla s\u0131k\u0131y\u00f6netim d\u00f6nemi sona erdi\u011finde s\u00f6z konusu yasaya dayan\u0131larak al\u0131nan kararlar\u0131 ge\u00e7erlili\u011fi de ortadan kalkar.<\/p>\n<p>\u0130\u015fte OHAL KHK\u2019lerinin yapt\u0131\u011f\u0131 Dan\u0131\u015ftay\u2019\u0131n saptad\u0131\u011f\u0131 bu hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 \u00e7ok geni\u015fletmekten ba\u015fka bir \u015fey de\u011fildir. 20 Temmuz rejimi bir yandan bireysel i\u015flemleri, \u00f6te yandan ise o i\u015flemleri de\u011fi\u015ftiren KHK\u2019leri yasala\u015ft\u0131rarak kal\u0131c\u0131 hale getirmi\u015ftir. Dan\u0131\u015ftay, salt idari i\u015flemin bile kal\u0131c\u0131 olmas\u0131n\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011funu saptam\u0131\u015fken, 20 Temmuz rejiminde hem idari i\u015flemler hem de genel, soyut, ki\u015filik d\u0131\u015f\u0131 kurallar OHAL\u2019le s\u0131n\u0131rl\u0131 olmayacak kal\u0131c\u0131 kurallar haline d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. E\u011fer Dan\u0131\u015ftay\u2019\u0131n 1989 karar\u0131 Anayasa\u2019n\u0131n gere\u011fiyse, yeni durumun Anayasal ge\u00e7erlili\u011finin olamayaca\u011f\u0131 da a\u00e7\u0131kt\u0131r.<\/p>\n<p>OHAL KHK\u2019lerinin yasala\u015fmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcn\u00fc a\u00e7\u0131k bi\u00e7imde kabul eden Ersan \u015een de onay prosed\u00fcr\u00fc ile yasa yapma prosed\u00fcr\u00fcn\u00fcn farkl\u0131 oldu\u011funa dayanarak KHK\u2019lerin hi\u00e7bir \u015fekilde yasala\u015famayaca\u011f\u0131n\u0131 savunmu\u015ftur. E\u011fer KHK\u2019de yer alan bir h\u00fck\u00fcm kal\u0131c\u0131 k\u0131l\u0131nmak isteniyorsa bu konuda yasa yapma prosed\u00fcr\u00fcne uyularak bir yasa \u00e7\u0131kar\u0131lmas\u0131 gerekir. \u201cKHK onay\u0131n\u0131n kanun olarak de\u011ferlendirilmesinin nedeni, OHAL\u2019den sonra da de\u011fi\u015fikliklerin kal\u0131c\u0131 olmas\u0131n\u0131 sa\u011flama amac\u0131na dayanmaktad\u0131r. Bu belirsizli\u011fin kayna\u011f\u0131 s\u00f6z konusu 20 Temmuz rejimi atipik OHAL KHK\u2019lerinin \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 128. Maddesi uyar\u0131nca TBMM Genel Kurulu\u2019na getirilerek yasala\u015ft\u0131r\u0131lmas\u0131n\u0131n hukuk d\u00fczenimiz i\u00e7inde yeri olmamas\u0131d\u0131r. Bilindi\u011fi gibi halihaz\u0131rda 20 Temmuz rejimi alt\u0131nda \u00e7\u0131kar\u0131lan OHAL KHK\u2019leri Meclis taraf\u0131ndan onaylanarak yasaya d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015ft\u00fcr. H\u00e2l b\u00f6yleyken, TBMM onay\u0131ndan sonra bu kararnameler AYM \u00f6n\u00fcne geldi\u011finde; AYM, OHAL KHK\u2019lerinin i\u00e7eri\u011fini inceleme f\u0131rsat\u0131 bulaca\u011f\u0131ndan,\u00a0<strong>\u00f6ncelikle s\u00f6z konusu d\u00fczenlemelerin bir yasa h\u00fckm\u00fc olamayaca\u011f\u0131n\u0131 saptamal\u0131\u00a0 sonra\u00a0 da\u00a0 bu\u00a0 d\u00f6nemde TBMM\u2019den yasa olarak ge\u00e7en t\u00fcm KHK\u2019leri iptal etmelidir<\/strong>.<\/p>\n<p><strong>Yasa Olarak Onanan OHAL KHK\u2019sine Y\u00f6nelik Yapt\u0131r\u0131m Ne Olabilir?<\/strong><\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi OHAL KHK\u2019lerinin yasala\u015fmas\u0131 Anayasa\u2019ya a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r. Bu ayk\u0131r\u0131l\u0131\u011f\u0131n hukuki yapt\u0131r\u0131m\u0131n\u0131n ne oldu\u011funun da ayr\u0131ca tart\u0131\u015f\u0131lmas\u0131 gerekir. OHAL KHK\u2019lerinin ola\u011fan d\u00f6nem KHK\u2019lerinden farkl\u0131 olarak yasa g\u00fcc\u00fcnde olma niteli\u011finin yasalar\u0131 de\u011fi\u015ftirebilmesinden de\u011fil, onlar\u0131 belli bir s\u00fcre i\u00e7in ask\u0131ya alabilmesinden geldi\u011fini belirtmi\u015ftik. OHAL ilan\u0131n\u0131 gerektiren ko\u015fullar\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in al\u0131nacak tedbirlerin ge\u00e7ici niteli\u011fi a\u00e7\u0131kt\u0131r. Ola\u011fan\u00fcst\u00fc Hal Kanunu\u2019nun yaln\u0131zca OHAL ilan\u0131n\u0131 takip eden ve OHAL s\u00fcresince ge\u00e7erli olan kurallar koydu\u011fu d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde, Anayasa ve OHAL kanununa dayanarak \u00e7\u0131kar\u0131lan OHAL KHK\u2019lerinin \u201ctedbir\u201d niteli\u011fini a\u015facak bi\u00e7imde yasala\u015fmas\u0131 ve s\u00fcreklile\u015fmesi m\u00fcmk\u00fcn de\u011fildir. Tedbir niteli\u011findeki kararlar\u0131 alacak organ ve kararla\u015fma usul\u00fc ile yasay\u0131 \u00f6nerecek, g\u00f6r\u00fc\u015fecek, kabul edecek organlar ve yasala\u015fma usulleri birbirinden tamamen farkl\u0131d\u0131r. Dolay\u0131s\u0131yla burada sorun nesnel, genel, soyut ve s\u00fcrekli kurallar\u0131n konmas\u0131 konusunda izlenecek usul\u00fcn ihlali durumunda ne t\u00fcr bir yapt\u0131r\u0131m\u0131n s\u00f6z konusu olaca\u011f\u0131d\u0131r.<\/p>\n<p>20 Temmuz rejiminin atipik OHAL KHK\u2019lerinin bu yaz\u0131da incelenen t\u00fcr\u00fcn\u00fcn \u00f6zelli\u011fi genel, soyut ve s\u00fcrekli kurallar\u0131 i\u00e7ermesidir. Bunlar maddi bak\u0131mdan kanun niteli\u011fi ta\u015f\u0131maktad\u0131r. Peki yetki kanunu olmadan, Cumhurba\u015fkan\u0131 ba\u015fkanl\u0131\u011f\u0131nda toplanan Bakanlar Kurulu\u2019nun \u00e7\u0131kard\u0131\u011f\u0131 bu kararnamelerin TBMM taraf\u0131ndan \u201conay\u0131\u201d onlar\u0131 yasa haline getirir mi? Daha a\u00e7\u0131k bir bi\u00e7imde, \u2018maddi anlamda yasa niteli\u011fi ta\u015f\u0131yan bir metin\u2019 TBMM Genel Kurulu\u2019na bir insan haklar\u0131 ve iki anayasa hukuk\u00e7usundan olu\u015fan bu makalenin yazarlar\u0131 taraf\u0131ndan sunulursa, Genel Kurul bu metni g\u00f6r\u00fc\u015f\u00fcp yasala\u015ft\u0131rabilir mi? Kararnamelerin yasala\u015fmas\u0131ndaki usul sorunu bu kadar a\u00e7\u0131kt\u0131r ve bunun hukuk d\u00fczenindeki anlam\u0131 yokluktur.<\/p>\n<p>Maddi anlamda yasa niteli\u011fi ta\u015f\u0131yan normlar\u0131n hangi organlar taraf\u0131ndan ve hangi usuller izlenerek konaca\u011f\u0131 Anayasa ve \u0130\u00e7t\u00fcz\u00fck\u2019te g\u00f6sterilmi\u015ftir. \u00d6zbudun\u2019un da belirtti\u011fi gibi ola\u011fan\u00fcst\u00fc halin s\u00fcresinin, konusunun ve b\u00f6lgesinin s\u0131n\u0131rlar\u0131n\u0131 a\u015fan kurallar\u0131n yasa ile d\u00fczenlemesi gerekir. Yasa ile d\u00fczenlemek demek yasama prosed\u00fcrlerine uyulmas\u0131 demektir. Yasa tasar\u0131 ya da teklifinin sunulmas\u0131, komisyonlarda ve genel kurulda g\u00f6r\u00fc\u015f\u00fclmesi bu prosed\u00fcrlerin temel a\u015famalar\u0131d\u0131r. Yasa tasar\u0131 ve teklifinin kim taraf\u0131ndan verilebilece\u011fi, komisyon ve genel kurulda g\u00f6r\u00fc\u015fme usulleri de Anayasa ve \u0130\u00e7t\u00fcz\u00fck\u2019te belirtilmi\u015ftir. \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn<\/p>\n<p>128. maddesine dayanarak komisyonlarda g\u00f6r\u00fc\u015f\u00fclmeden do\u011frudan TBMM Genel Kurulu\u2019na getirilen KHK\u2019lerin yasa olarak kabul edilmesi yasaya ge\u00e7erlilik kazand\u0131ran b\u00fct\u00fcn prosed\u00fcrlerin atlanmas\u0131 anlam\u0131na gelecektir ki bu hukuken m\u00fcmk\u00fcn de\u011fildir. Bu durumda esasen, yasama organ\u0131n\u0131n iradesi sakat oldu\u011fu i\u00e7in ortada bir yasa da mevcut de\u011fildir. Normal ko\u015fullarda, bu eksikli\u011fin saptanmas\u0131 ve ilgili yasa de\u011fi\u015fikliklerinin \u201cyok\u201d h\u00fckm\u00fcnde oldu\u011fu tespit edilmelidir. Ancak Anayasa hukukunda AYM\u2019nin yoklu\u011fu tespit etmesi gibi bir usul olmad\u0131\u011f\u0131 ve Resmi Gazete\u2019de yasa ismiyle yay\u0131mlanan t\u00fcm metinlerin sonu\u00e7lar\u0131 hemen do\u011fdu\u011fu i\u00e7in tek hukuki yol bu yasalar\u0131n esasa girmeksizin AYM taraf\u0131ndan iptal edilmesidir.<\/p>\n<p>Bu durumda OHAL KHK\u2019lerinin yasala\u015fmas\u0131n\u0131n ard\u0131ndan Anayasa Mahkemesi nas\u0131l karar verecektir?<\/p>\n<p>Yukar\u0131da belirtildi\u011fi gibi e\u011fer bir OHAL KHK\u2019si TBMM\u2019de yasala\u015fmas\u0131ndan sonra da OHAL KHK\u2019si olarak denetlenemiyorsa bu onun hi\u00e7bir zaman denetlenemeyece\u011fi anlam\u0131na gelir ki bu ola\u011fan\u00fcst\u00fc hali anayasal bir kurum olmaktan \u00e7\u0131kar\u0131r. Dolay\u0131s\u0131yla Anayasa Mahkemesi\u2019nin bu yasalar\u0131 s\u0131radan bir denetime tabii tutmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Mahkeme\u2019nin \u00f6n\u00fcne gelen yasa maddelerinin anayasaya uygunluk denetiminden \u00f6nce bu maddelerin i\u00e7inde yer ald\u0131klar\u0131 OHAL KHK\u2019lerinin OHAL KHK\u2019si olarak anayasal denetiminin yap\u0131lmas\u0131 gerekir.<\/p>\n<p>\u0130kincisi KHK ve yasa aras\u0131ndaki anayasal fark ortaya konmal\u0131d\u0131r ki bu \u00f6n\u00fcm\u00fczdeki sorun bak\u0131m\u0131ndan ola\u011fan\u00fcst\u00fc bir anayasal \u00f6neme sahiptir. Yukar\u0131da ayr\u0131nt\u0131l\u0131 bi\u00e7imde tart\u0131\u015f\u0131ld\u0131\u011f\u0131 gibi OHAL KHK\u2019lerinin yasa haline gelmesi hi\u00e7bir bak\u0131mdan m\u00fcmk\u00fcn de\u011fildir. OHAL ko\u015fullar\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in ge\u00e7ici tedbirler koymak i\u00e7in d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015f ve anayasa koyucu taraf\u0131ndan bununla s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f bir yetki olan Cumhurba\u015fkan\u0131 ba\u015fkanl\u0131\u011f\u0131nda toplanm\u0131\u015f Bakanlar Kurulu\u2019nun OHAL KHK\u2019si \u00e7\u0131karma yetkisi, asli ve genel bir yetki olan yasama yetkisinin yerini alamaz. Yani \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 128. Maddesine dayan\u0131larak OHAL KHK\u2019lerini yasala\u015ft\u0131rmak, ge\u00e7ici tedbirleri, yasa yapma prosed\u00fcrlerine uymadan yasala\u015ft\u0131rmak hukuk d\u00fczenimiz i\u00e7inde olanakl\u0131 de\u011fildir. Bir yasa metni ancak Anayasa\u2019da belirtilen usuller izlenerek kabul edilirse yasa niteli\u011fi kazan\u0131r.<\/p>\n<p>Yasala\u015fm\u0131\u015f olan t\u00fcm OHAL KHK\u2019leri bak\u0131m\u0131ndan durum ayn\u0131 oldu\u011fu i\u00e7in yani bir OHAL KHK\u2019sinin yasa olmas\u0131 m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 esasen yok h\u00fckm\u00fcnde olan t\u00fcm yasalar\u0131n bu kural kapsam\u0131nda iptal edilmesi gereklidir. Dahas\u0131 hi\u00e7 y\u00fcr\u00fcrl\u00fc\u011fe girmemi\u015f olmas\u0131 gereken bu d\u00fczenlemelere ili\u015fkin verilecek iptal karar\u0131n\u0131n da normal iptal kararlar\u0131ndan farkl\u0131 olmas\u0131 gerekir. AYM\u2019nin iptal etti\u011fi h\u00fck\u00fcmlerin kald\u0131rd\u0131\u011f\u0131 yasa h\u00fck\u00fcmleri iptal karar\u0131 sonras\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girmez. Oysa yok h\u00fckm\u00fcnde olan bir yasa h\u00fckm\u00fcn\u00fcn iptali, iptal kararlar\u0131n\u0131n geriye y\u00fcr\u00fcmeyece\u011fi kural\u0131ndan da etkilenemez. Bir ba\u015fka deyi\u015fle yasay\u0131 de\u011fi\u015ftirme g\u00fcc\u00fc olmayan bir d\u00fczenlemeyle yasa de\u011fi\u015ftirilemeyece\u011fine g\u00f6re KHK\u2019lerin kald\u0131rd\u0131\u011f\u0131 t\u00fcm h\u00fck\u00fcmlerin de hi\u00e7 kald\u0131r\u0131lmam\u0131\u015f gibi y\u00fcr\u00fcrl\u00fc\u011fe girmesi gerekecektir.<\/p>\n<p>Mahkeme\u2019nin burada sergileyece\u011fi tav\u0131r T\u00fcrkiye\u2019de anayasal denetimin var olup olmad\u0131\u011f\u0131n\u0131 g\u00f6sterecek turnusol ka\u011f\u0131d\u0131 niteli\u011findedir. \u00c7\u00fcnk\u00fc bu a\u015famada Mahkeme\u2019nin yasa olarak \u00f6n\u00fcne getirilen metinlerin \u201cbirer yasa olarak yok h\u00fckm\u00fcnde\u201d oldu\u011funu tespit etmekten ba\u015fka tek se\u00e7ene\u011fi vard\u0131r. O se\u00e7enek de hukuk devletinin en b\u00fcy\u00fck kazan\u0131mlar\u0131ndan olan anayasa mahkemesinin fiili olarak ilgas\u0131d\u0131r.
